These Terms and Conditions ("Terms") govern access to and use of the CatchMyTow platform ("CatchMyTow," "we," "our," or "us").

By accessing or using our website or communication services, you agree to be bound by these Terms.

1. Description of Services

CatchMyTow provides communication technology that enables towing and roadside assistance providers to collect, manage, and transmit service request information.

CatchMyTow acts solely as a communication and information facilitation platform.

CatchMyTow does not directly provide towing, roadside assistance, vehicle transport, or emergency services.

All towing services are provided independently by third-party towing providers.

2. Use of the Platform

You agree to use the platform only for lawful purposes and in connection with legitimate towing or roadside assistance requests.

You agree not to:

  • Provide false or misleading information
  • Attempt to disrupt or interfere with the platform
  • Use the platform for unlawful, fraudulent, or abusive purposes
  • Reverse engineer, copy, or exploit the platform without authorization

We reserve the right to suspend or restrict access if misuse is detected.

3. Service Communications and SMS Messaging

When requesting roadside assistance, you may receive service-related communications, including SMS messages, to confirm pickup location, drop-off destination, or other details necessary to complete your request.

SMS Program Details

  • Message frequency varies per service request
  • Typically limited to 1-2 messages per active towing request
  • Message and data rates may apply depending on your mobile carrier plan

By providing your mobile number and verbal consent during a live phone interaction, you agree to receive transactional SMS messages related to your active service request.

To opt out of SMS communications, reply STOP.

SMS communications are strictly service-related and are not promotional. Mobile carriers are not responsible for delayed or undelivered messages.

4. Third-Party Towing Providers

CatchMyTow facilitates communication between customers and independent towing providers.

We do not control, supervise, or guarantee:

  • The availability of towing providers
  • The quality of services provided
  • Response times
  • Pricing
  • Professional conduct

Any service dispute must be resolved directly with the towing provider.

5. No Emergency Guarantee

CatchMyTow does not guarantee immediate response times or emergency dispatch.

If you are in a life-threatening emergency, you should contact local emergency services directly.

6. Limitation of Liability

To the maximum extent permitted by law, CatchMyTow shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Service delays or failures by third-party towing providers
  • Loss of property, vehicle damage, or personal injury resulting from towing services
  • Telecommunications delays or delivery failures

Our total liability for any claim arising from use of the platform shall not exceed the amount paid, if any, for use of our services.

7. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding:

  • Availability
  • Reliability
  • Accuracy
  • Fitness for a particular purpose

We do not warrant that the platform will be uninterrupted or error-free.

8. Indemnification

You agree to indemnify and hold harmless CatchMyTow from any claims, liabilities, damages, or expenses arising out of:

  • Your misuse of the platform
  • Your violation of these Terms
  • Disputes between you and a towing provider

9. Privacy

Your use of the platform is also governed by our Privacy Policy

10. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time without prior notice.

11. Changes to These Terms

We may update these Terms from time to time.

When we do, we will revise the "Last Updated" date at the top of this page.

Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United States and the applicable state of operation, without regard to conflict of law principles.
