CatchMyTow provides communication technology that enables towing providers to collect and manage service request information.
CatchMyTow does not provide towing, roadside assistance, dispatching, or transportation services.
2. Platform Role
CatchMyTow is a technology provider only.
We do not act as:
- A towing provider
- A dispatcher
- A broker
- A transportation intermediary
All services are provided by independent towing providers.
3. Independent Providers
Towing providers are independent third parties and are not employees, agents, or representatives of CatchMyTow.
We do not control or guarantee:
- Service availability
- Pricing
- Response times
- Service quality
All disputes must be resolved directly with the towing provider.
4. Use of the Platform
You agree to use the platform lawfully and not to:
- Provide false information
- Interfere with the platform
- Use the platform for fraud or abuse
We may suspend access for misuse.
5. Automated Systems
CatchMyTow uses automated systems, including artificial intelligence, to collect and process service request information.
You may interact with an automated system rather than a human.
6. Call Recording
All calls handled through the platform are recorded.
By continuing a call after notice is provided, you consent to such recording where permitted by law.
7. SMS Communications
SMS messages are sent on behalf of towing providers.
By providing your phone number and consent, you agree to receive transactional messages.
You represent that you are authorized to use the provided phone number.
You may opt out by replying STOP.
8. Responsibilities of Towing Providers
Towing providers are solely responsible for:
- Obtaining required customer consents
- Providing legally required disclosures
- Compliance with applicable laws
- Service delivery and customer interactions
CatchMyTow is not responsible for their actions.
9. No Guarantee of Accuracy
CatchMyTow does not guarantee the accuracy or completeness of information collected through automated systems.
Users must verify all service details before relying on them.
10. No Emergency Guarantee
CatchMyTow does not guarantee immediate response.
In emergencies, contact local emergency services.
11. Limitation of Liability
To the maximum extent permitted by law, CatchMyTow is not liable for:
- Indirect or consequential damages
- Service failures by towing providers
- Loss, damage, or injury related to services
- Communication delays or failures
Total liability shall not exceed the amount paid for the service.
12. Disclaimer of Warranties
The platform is provided "as is" without warranties of any kind.
13. Indemnification
You agree to indemnify CatchMyTow from claims arising from:
- Misuse of the platform
- Violation of these Terms
- Disputes with towing providers
14. Dispute Resolution
All disputes shall be resolved through binding arbitration on an individual basis.
You waive the right to participate in class actions.
15. Modifications
We may modify the platform or these Terms at any time.
Continued use constitutes acceptance.
16. Governing Law
These Terms are governed by U.S. law and applicable state law.
